The courts have ruled on this before. Now that is a state law, it might change the stakes.

Senators Saban, Swinney, and Kelly will most certainly get this passed in their respective states trust in that. I believe so, yes. The so-called pay for play is a scholarship issue. Earning money while playing is an NCAA eligibility issue.
