Independant contractor is not going to fly for them. There are requirements and no athletic program could function with them. As to your comment, it depends on what they are labeled as. They could be independent contractors which could eliminate some of the retirement issues.

The vast majority of schools will be forced to drop programs if they become employees and APP most probably is going to be one of them.
One would think that Title IX would also be affected. If you are hiring for 85 football player positions, that is different from offering scholarships. Get a trade… I’ve said it for years now. I’m a GC and all my trades are in their mid late forties . There’s no one behind them. You’ll be able to name your price. Administrators & faculty would be wise to review what they offer at what price and what message is communicating to their students and the person paying for their time at that instituion.
